1. About Maintain

maintain is a fitness and nutrition application designed to help users track workouts, nutrition, weight and progress, including people who are losing weight while taking GLP-1 medications.

The Service provides general fitness, nutrition and educational information.

maintain is not a healthcare provider, medical service or medical device, and does not provide medical advice, diagnosis or treatment.

You must meet the minimum legal age required to use the Service in your country.

By using maintain, you confirm that:

• The information you provide is accurate to the best of your knowledge.
• You will use the Service lawfully.
• You will comply with these Terms.
• You will not use another person's account without permission.

• All activity carried out through your account.

You must not share your account with another person or allow another person to access it.

If you believe someone has accessed your account without your permission, please contact us.

4. Account Deletion

You can delete your maintain account and associated data using the account deletion functionality available within the App.

Deleting your account may permanently remove your workouts, weight history, nutrition information, progress and other account data.

Once your account has been deleted, this information may not be recoverable.

5. Fitness and Medical Disclaimer

maintain provides general fitness, nutrition and educational information only.

Nothing within the Service is intended to:

• Diagnose, treat, cure or prevent any disease or medical condition.
• Replace advice from a doctor or other qualified healthcare professional.
• Determine whether a medication is appropriate for you.
• Tell you to start, stop or change a medication.
• Provide medical or clinical advice.

This includes information relating to GLP-1 medications such as Ozempic, Wegovy, Mounjaro and Zepbound.

You should speak with an appropriate healthcare professional before beginning a new exercise or nutrition programme, particularly if you have a medical condition, are taking medication, or have concerns about your health.

Never change, stop or alter a prescribed medication based on information provided by maintain.

6. Exercise Safety

You are responsible for deciding whether an exercise or workout is appropriate for you.

You should exercise within your own capabilities and use appropriate equipment and technique.

Stop exercising if you experience pain, dizziness, fainting, chest pain, unusual shortness of breath or other concerning symptoms, and seek appropriate medical attention where necessary.

maintain does not guarantee that a particular workout, exercise or training recommendation will be suitable for you.

7. Nutrition Information

maintain may provide calorie targets, protein targets, nutrition tracking and general nutrition information.

These targets and recommendations are estimates intended to support general fitness and weight-management goals.

They are not medical or dietary prescriptions.

Individual nutritional requirements vary, and you are responsible for determining whether the information provided is appropriate for you.

8. Personalised Recommendations

maintain may use information you provide, such as your goals, age, sex, weight, training preferences and workout history, to provide personalised fitness and nutrition recommendations.

These recommendations are intended to support your use of the Service and are not medical advice.

You remain responsible for deciding whether a recommendation is appropriate for you.

9. Free and Premium Features

maintain may offer both free and paid features.

The features available through each plan may change from time to time.

Premium features may include:

• Nutrition tracking
• Custom exercise swaps
• Workout progression and recommendations
• Advanced progress analytics
• Weekly progress summaries
• Personalised training adjustments
• Extended workout history
• Priority support

The features included in Premium will be shown to you before purchase.

10. Subscriptions and Payments

Certain features of maintain require a paid subscription.

Payments may be processed by third-party payment providers, including Stripe.

You agree to pay the price displayed when you purchase a subscription.

Where a subscription automatically renews, you will be charged according to the renewal terms presented when you subscribe.

Subscription prices may change in the future. Where required by law, we will provide notice before a price change takes effect.

11. Cancellation and Refunds

You can cancel your Premium subscription according to the cancellation process provided by the platform through which you purchased it.

Cancellation normally prevents future renewal but does not necessarily provide a refund for a period already paid for.

Nothing in these Terms affects any statutory consumer rights you may have under applicable law.

12. Intellectual Property

All intellectual property rights in maintain belong to us or our licensors.

This includes, but is not limited to:

• The maintain name and branding.
• Logos and graphics.
• App design.
• Software.
• Text and educational content.
• Exercise content.
• Other materials provided through the Service.

You are granted a limited, non-exclusive, non-transferable licence to use the App for your personal, non-commercial use.

You must not:

• Copy or reproduce the Service.
• Modify or create derivative works.
• Reverse engineer the App except where legally permitted.
• Sell, rent or sublicense the Service.
• Use the Service to create a competing product.
• Remove proprietary notices or branding.

13. Your Content

You retain ownership of information and content that you enter into maintain.

You grant us the rights necessary to store, process and display that information solely for the purpose of providing and operating the Service.

You are responsible for ensuring that anything you submit does not violate another person's rights or applicable law.

14. Acceptable Use

You must not:

• Use maintain for unlawful purposes.
• Attempt to access another user's account.
• Attempt to gain unauthorised access to our systems.
• Interfere with the operation or security of the Service.
• Introduce malicious software or code.
• Scrape or systematically collect information from the App.
• Abuse, threaten or harass our staff or users.
• Misrepresent your identity or relationship with maintain.
• Use the Service to develop a competing product.

15. Availability of the Service

We aim to keep maintain available and functioning properly, but we do not guarantee that the Service will always be available, uninterrupted or error-free.

We may temporarily suspend the Service for reasons including:

• Circumstances outside our reasonable control.

We may also modify, add or remove features from maintain.

Everyone responds differently to exercise, nutrition and weight-loss programmes.

We do not guarantee that using maintain will result in:

• A particular amount of weight loss.
• A particular change in body composition.
• Preservation or gain of a particular amount of muscle.
• Increased strength.
• Any particular health or fitness outcome.

"Lose weight. Keep your muscle." is Maintain's product positioning and does not constitute a guarantee of any particular result.

Your results depend on many individual factors.

18. Limitation of Liability

To the maximum extent permitted by applicable law, maintain and its operators, employees, contractors and service providers will not be liable for indirect, incidental, special or consequential losses arising from your use of the Service.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation.

You use maintain at your own discretion and risk.

19. Suspension and Termination

You can stop using maintain at any time.

We may suspend or terminate your access if you:

• Materially breach these Terms.
• Use the Service unlawfully.
• Engage in fraud or abuse.
• Attempt to compromise the security of the Service.
• Otherwise misuse the Service.

Where reasonably possible, we will provide notice before terminating your account.

Termination does not affect rights or obligations that arose before termination.

Your continued use of maintain after changes take effect constitutes acceptance of the updated Terms, to the extent permitted by law.

22. Governing Law

These Terms are governed by the laws of England and Wales.

Any disputes will be subject to the courts of England and Wales, except where applicable consumer protection law gives you the right to bring proceedings elsewhere.
